TERMS AND CONDITIONS

§1. General and Application
The following terms and conditions shall apply for all contracts between the customer and the Maria Black Jewellery APS about the delivery of goods, which are ordered in Maria Black Jewellery APS’s online shop under the web-site www.maria-black.com
§ 2. Account
(1) The customer is responsible for maintaining the confidentiality of its account and password and for restricting access to its computer to prevent unauthorised access to its account. The customer agrees to accept responsibility for all activities that occur under its account or password.
(2) The customer should take all necessary steps to ensure that the password is kept confidential and secure and should inform Maria Black Jewellery APS immediately if it has any reason to believe that its password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.
(3) The customer shall ensure that the details which are provided to Maria Black Jewellery APS are correct and complete. The customer shall inform Maria Black Jewellery APS immediately of any changes to the information that has been provided at the time of registration.
§ 3. Conclusion and subject matter of contract
(1) The customer places the order by carrying out the following steps:
(a) Select product(s) and “add to bag”.
(b) Select “view Cart” to see detailed information of the products to be purchased. To proceed with the purchase click on “Final Checkout”.
(c) Enter all personal information and click on “Continue”.
(d) Choose relevant credit card as your payment method and enter all credit card details.
(2) After placing an order, Maria Black Jewellery APS will send an email to the customer, which confirms receipt of the order and contains the details of the order. This email does not constitute the acceptance of the offer.
(3) Maria Black Jewellery APS accepts the offer either by shipping the products to the address provided by the customer or by confirming the shipping by an email. The contract has not been concluded before Maria Black Jewellery APS has accepted the offer.
(4) The payment will be collected after the order has been shipped.
§ 4. Prices and conditions of payment
(1) All prices stated on the online-shop are in DKK and inclusive 25% Danish VAT. Shipping costs are not included. For detailed shipping costs, see § 5 below. Creditcard fees will never exceed the fixed once from the credit card suppliers.
(2) For payment Maria Black Jewellery APS only accepts the following credit cards:
Visa, EuroCard/MasterCard, American Express, Visa Electron, Mastercard Direct.
Maria Black Jewellery APS does not accept other methods of payment.
(3) In case of delivery outside EU the customer is obliged to bear the customs duties and further costs incurred. Customs policies vary widely from country to country, so the customer should contact the local customs office for further information.
§ 5. Delivery
(1) Products which are “on stock” will be delivered inside Denmark within 2-3 working days and the EU within 7 working days and outside the EU within 14 working days.
(a) If the customer orders several items and one or more of the ordered items are currently out of stock, Maria Black Jewellery APS will not ship the goods until each of the ordered items is back in stock again. The delivery time in that case may take up to eight weeks for customers within the EU and up to 10 weeks for customers who are located outside the EU.
(3) We deliver with GLS in Denmark and UPS worldwide.
(4) The shipping costs depend on the customer’s location:
Free delivery if you purchase for more than 750 DKK inside Scandinavia ( Denmark, Sweden, Norway )
Free delivery if you purchase for more than 150 € inside Europe.
Free delivery if you purchase for more than 200 € inside rest of the world.
Delivery prices:
(a) place of delivery inside Denmark: 50 DKK
(b) place of delivery inside Scandinavia: 100 DKK (to Norway 160 DKK)
(c) place of delivery inside EU: 110 DKK (to Switzerland 160 DKK)
(d) place of delivery inside North- & South America: 300 DKK
(e) place of delivery rest of the world : 150 DKK
(5) Maria Black Jewellery APS will not be held responsible for any delay or failure to comply with its obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
(6) The risk of loss or damages will not pass to the customer until the goods have been delivered to the customer.
§ 6. Returned goods
(1) The customer has the right to return new unworn or unused goods within 14 days.
Goods should be returned in their original packaging where relevant. The 14-days-period shall begin to run after receipt of this instruction (e.g. via e-mail, fax), but in any event no earlier than the goods have been received by the customer. In order to comply with the 14-days-period, it shall be sufficient for the products in question to have been dispatched as new and unused within this period. The customer is not entitled to return goods to a Maria Black store, but is only entitled to return the goods directly to Maria Black Jewellery APS.
The return of the products has to be addressed to Maria Black Jewellery APS, Lille Strandstræde 14, E2, 1254 Copenhagen K, Denmark
(2) In the event of the return of the products, any services and products received, and any profit derived there from, shall be returned.
(3) Maria Black Jewellery APS will only cover shipping costs incurred in returning the product(s) if the return is a result of our error.
(4) Articles can only be returned in case they are still welded and packed in their original hygiene slips and/or packages. Our return policy does not affect your statutory rights.
EXCHANGE
Denmark :
We offer one free exchange if you have bought something and want another size or product/style.
If you exchange more than 1, you have to pay for the shipping yourself.
Rest of the world :
If you want something exchanged you have to pay for the shipping yourself. We'll send you a link to pay for the shipping.
§ 7. Retention of title
Maria Black Jewellery APS retains title to the goods until receipt of all payments in full.
§ 8. Warranty and liability
(1) Maria Black Jewellery APS will give a two-year guarantee on all products.
§ 9. Copyright and use of the website
(1) Also after the purchase Maria Black Jewellery APS is still the owner of all intellectual property rights, particularly design rights and copyrights, concerning its goods.
(2) The customer is not entitled to extract and/or re-utilise parts of the contents of the website. In particular, the customer may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (either once or many times) for re-utilisation of any substantial parts of this website.
(3) The customer must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired.
§ 10. Data protection
(1) Maria Black Jewellery APS is entitled to collect, process and use our customers’ data in accordance with applicable data protection law.
(2) Maria Black Jewellery APS will only use the customer’s data for purpose which the data are provided for and/or for correspondence with the customer.
(3) If necessary for the processing of payment, Maria Black Jewellery APS will transfer the customer’s payment data to the credit institute which is instructed with the payment.

De følgende vilkår og betingelser gælder for alle kontrakter mellem kunden og Maria Black Smykker APS om levering af varer, der bestilles i Maria Black Jewellery APS online-shop under web-site www.maria-black.com
(1) Kunden er ansvarlig for at opretholde tavshedspligten om sin konto og password gennem begrænset adgang til sin computer for at forhindre uautoriseret adgang til sin konto. Kunden indvilliger i at påtage sig ansvaret for alle aktiviteter, der finder sted i henhold til sin konto eller adgangskode.
(2) Kunden skal tage alle nødvendige skridt til at sikre, at adgangskoden er fortrolig og sikker og bør informere Maria Black Jewellery APS øjeblikkeligt, hvis det har nogen grund til at tro, at andre har fået kendskab til passwordet.
(3) Kunden skal sikre, at oplysninger, der gives til Maria Black Jewellery APS er korrekte. Kunden skal underretter Maria Black Jewellery APS om eventuelle ændringer i de oplysninger, der er givet på tidspunktet for registreringen.
(1) Kunden bestiller ved at udføre følgende trin:
(A) Vælg produkt(er) og "Add to cart".
(B) Vælg "show cart" for at se detaljerede oplysninger om de produkter, der skal købes. For at gå videre med købet klik på "Final Checkout".
(C) Indtast alle personlige oplysninger og klikke på "continue".
(D) Vælg relevante kreditkort som din betalingsmetode og indtaste alle kreditkortoplysninger.
(2) Efter at have placeret en ordre, vil Maria Black Jewellery APS send en mail til kunden, som bekræfter modtagelsen af ordren, og indeholder oplysninger om ordren.
(3) Maria Black Jewellery APS accepterer tilbuddet, enten ved forsendelse af varer til den adresse som kunden har indtastet eller ved at bekræfte shipping via en e-mail. Kontrakten ikke er indgået inden Maria Black Jewellery APS har accepteret tilbuddet.
(4) Betalingen vil blive hævet, efter at ordren er afsendt.
§ 4. Priser og betingelser for betaling
(1) Alle anførte priser på online-shop er i DKK og inklusiv 25% dansk moms. Forsendelsesomkostninger er ikke inkluderet. For detaljerede forsendelsesomkostninger, se § 5 nedenfor. Transaktionsgebyret vil ikke overstige de af Nets fastsatte gebyrer.
(2) For betaling Maria Black Jewellery APS accepterer følgende kreditkort:
Visa, Eurocard / Mastercard, American Express, Visa Electron, Mastercard Direct.
Maria Black Smykker APS ikke acceptere andre betalingsformer.
(3) I tilfælde af levering uden for EU kunden er forpligtet til at betale eventuel told og andre yderligere omkostninger. Toldpolitikken varierer meget fra land til land, så kunden skal kontakte det lokale toldkontor for yderligere information.
§ 5. Levering
(1) Produkter, som er "på lager" vil blive leveret i Danmark inden for 2-3 hverdage og EU inden for 7 hverdage og uden for EU inden for 14 hverdage.
(A) Hvis kunden bestiller flere produkter og en eller flere af de bestilte varer ikke er på lager, vil Maria Black Jewellery APS ikke afsende varerne, indtil hver af de bestilte varer er tilbage på lager igen. Leveringstiden i så fald kan tage op til otte uger for kunder inden for EU og op til 10 uger for kunder som befinder sig uden for EU.
(3) Vi levere med GLS (alm.) til virksomheder og GLS privat (pakkeshops) til private i Danmark og UPS i resten af verden.
(4) De forsendelsesomkostninger afhænger af kundens placering:
Gratis levering hvis du køber for mere end 750 kr. i Skandinavien (Danmark, Sverige, Norge)
Gratis levering hvis du køber for mere end 150 € i for Europa.
Gratis levering hvis du køber for mere end 200 € i resten af verden.
Levering priser :
(a) leveringssted indeni Danmark: 50 DKK.
(b) leveringssted inde Skandinavien: 100 kr (Levering til Norge koster 160 DKK) .
(c) leveringssted inden for EU: 110 DKK (Levering til Schweiz koster 160 DKK).
(d) leveringssted inde i Nord-og Sydamerika: 300 DKK.
(e) leveringssted resten af verden: 150DKK.
(5) Maria Black Jewellery APS vil ikke blive holdt ansvarlig for eventuelle forsinkelser eller manglende opfyldelse af sine forpligtelser i henhold til disse betingelser, hvis forsinkelsen eller svigt opstår uanset årsag, som er uden for vores rimelige kontrol. Denne betingelse påvirker ikke dine lovbestemte rettigheder.
(6) Risikoen for tab eller skader, vil ikke overgår til kunden, før varerne er blevet leveret til kunden.
§ 6. Returvarer
(1) Kunden har ret til at returnere ubrugte varer inden for 14 dage.
Varer skal returneres i deres originale emballage. Den 14-dage-perioden begynder at løbe efter modtagelsen af varerne (fx via e-mail, fax), men under alle omstændigheder ikke tidligere end varerne er blevet modtaget af kunden. For at overholde 14-dages-periode, skal det være tilstrækkeligt for de pågældende produkter at de er afsendt som ny og ubrugt i denne periode. Kunden er ikke berettiget til at returnere varerne til en Maria Black butik, men er kun berettiget til at returnere varerne direkte til Maria Black Jewellery APS.
Returnering af produkterne skal sendes til Maria BlackJewellery APS, Lille Strandstræde 14, E2, 1254 København K, Danmark.
(2) Maria Black Jewellery APS vil kun dække forsendelsesomkostninger i forbindelse med returnering af produktet(erne) hvis det er vores fejl.
(3) Varer kan kun returneres hvis de stadig er pakket ind i deres oprindelige indpakning. Vores politik for tilbagesendelse påvirker ikke dine lovbestemte rettigheder.
OMBYTNING
Danmark :
Vi tilbyder at ombytte din vare til en anden str. eller produkt/model gratis første gang.
De efterfølgende gange skal du selv betale for ombytningen.
Resten af verden :
Ønsker du at ombytte en vare skal du selv betale for leveringen.
§ 7. Ejendomsforbehold
Maria Black Jewellery APS bevarer ejendomsretten til varerne, indtil modtagelse af alle betalinger i fuldt omfang.
§ 8. Garanti og ansvar
(2) Både oxidering og forgyldning slides af ved normal brug, og smykker skal løbende vedligeholdes for at de bliver ved med at se ud som da de blev købt.
§ 9. Ophavsret og brug af hjemmesiden
(1) Også efter købet er Maria Black Jewellery APS er stadig ejer af alle intellektuelle ejendomsrettigheder, især mønsterrettigheder og ophavsrettigheder, vedrørende dens goder.
(2) Kunden må ikke bruge hjemmesiden på nogen måde, der forårsager til at hjemmesiden afbrydes, beskadiget eller bliver forringet.
(1) Maria Black Jewellery APS er berettiget til at indsamle, behandle og bruge vores kunders data i overensstemmelse med gældende databeskyttelseslovgivning.
(3) Hvis det er nødvendigt for behandlingen af betalingen, vil Maria Black Jewellery APS overføre kundens betaling data til kredit institut, som er instrueret med betalingen.
